These terms and conditions outline the rules and regulations for the use of the Sessions Academy Website. Sessions Academy is located at:

These Terms and Conditions together with the Privacy Policy create an agreement which will remain in force every time you log on to use the service. It extends through all services including virtual classrooms, prerecorded, group and private lessons. By using this service you affirm acceptance of these terms and conditions in full. Do not continue to use Sessions Academy website if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “Sessions Academy”, “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of USA. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 

Scope of Business – Sessions Academy operates an online music school made up of 6 different types of training and services available to visitors and members.

  • Live virtual classrooms available to groups of students who are members of Sessions Academy using video conferencing technology
  • Prerecorded lessons available to members (these are primarily on-demand video lessons stored on Vimeo servers)
  • Master Class on-demand video lessons not included in membership which are available for purchase
  • Private music lessons with contracted teachers via virtual classrooms using video conferencing technology
  • Group and private workshop service for schools provided by Sessions instructors using video conferencing technology

 

Membership – Currently there are 2 membership models for individuals and 3 memberships for schools:

Student Memberships:

SchoolBeats Student –  Access to workshops and video lesson library.

Private Lesson – Access to workshop Videos, video lessons, (1) 45 minute private online lesson per month.

School Memberships:

SchoolBeats Membership – Teacher Version. Schools receive a customized page with website tools, group workshop classrooms, prerecorded lessons and various organized lesson content. Teachers can use SchoolBeats in the classroom or online teaching sessions via screen share. Students are not registered and cannot access video lessons on their own devices.

SchoolBeats Premium Membership – School Paid Version – Schools purchase a predetermined amount of Student Memberships for their students during the school year at a discount (minimum order for Premium is 50 students). Students do not need to purchase their own Student Membership if the school purchases a Premium Membership. Premium discounts may be offered to schools we distribute books to as the video lessons may reinforce the books.

Book Club Membership – Includes discounts on bulk school book orders, a paid SchoolBeats membership, student scholarship program and PO and school billing available for books. This is a free membership for schools that order Hal Leonard materials through Sessions.

Users give Sessions Academy permission to charge membership fees automatically on a recurring monthly basis. A membership is NOT required for students wanting to book private lessons with instructors and not use membership services.

SchoolBeats Program Members – Please note that Sessions SchoolBeats classroom pages are offered, licensed for non-profit educational music programs only and may not be used in any for-profit lessons or training. The free classroom version of SchoolBeats requires members to log into their account every 60 days to maintain an active membership. Sessions reserves the right to delete user accounts and SchoolBeat pages that have not been logged into for 60 days or more (for any outstanding free teacher versions). Teachers may log in to use the site tools at school to instruct students, but please don’t give your classroom page password to students. Sessions maintains 6 music workshop rooms that contain on-demand prerecorded workshops for your use with students. (Currently, live workshop rooms are not active on our site). Students who maintain a membership plan may directly access group classrooms when a class has been advertised and the teacher as entered the room. These rooms can also be used for live webinar conferencing workshops. Both require active internet access and the ability to show online content to your class with a screen and speakers. We are not responsible for content that is unable to be shown or recorded due to system failure. Adult instructors should always be present in live streaming classes and workshops are recorded and may become available on-demand for visitors. Links to music websites including sites we may list are provided as music resources. We are not affiliated with them and you agree to use sites at your own risk. Memberships that we may advertise and include to 3rd party sites are subject to change or cancellation at any time and members may have to obtain their own paid memberships. The SchoolBeats Program may be changed or cancelled at any time and schools that do not follow these terms may be canceled from the program. By your presence on our website you agree to our site terms, conditions and privacy policy.

Video Conference Workshop Rooms and Workshops – (Currently, live workshop rooms are not active on our site). Teachers agree that Sessions Academy may discontinue use/access to our video conference rooms at any time and understand that rooms may not operate as anticipated at all times. Teachers and students will hold Sessions Academy harmless for issues arising out of the use of these video conference rooms. Teachers agree to notify Sessions Academy immediately should issues arise in rooms. The use of our video conference rooms do not constitute a contract, agreement or guarantee of ongoing use. If teacher would like to have our group video conference classrooms deleted from their SchoolBeats page please contact Sessions Academy so that we may delete the room directly from your issued SchoolBeats page.

Spotlight Interviews and Performance Recordings – Teachers may agree to be interviewed  about their school program. Finished interviews will be posted on Sessions YouTube channel, Facebook page, Instagram account and on the Sessions website blog. No compensation will be paid or received in exchange for interviews and Sessions will not be held responsible for any damages that occur as a result of aired interviews. Students in middle or high school may also be chosen to perform an original piece or a derivative of a work to be aired in the same area. Guardians and students will be required to sign waivers and may contact us in writing at any time to take down any student performance from our social media. Again there is no compensation involved and Sessions cannot be held responsible for damages incurred as a result of recordings. Students may submit their own video. We will not host copyrighted works from other artists on our servers or YouTube channel and students are advised to obtain a legal copyright for any new original music they submit for their own protection.

Refunds – Sessions Academy strives for 100% customer satisfaction. We have a no hassle policy and will happily refund any unused portion of a monthly membership fee upon written notice from a customer prorated from the date of notice through the end of the period paid for. Refunds are made to the same source originally paid. Regarding private lessons, we understand that some cancellations are inevitable, and some lessons will not be successful due to the nature of technology issues that arise from live video conferencing. Students may cancel a live lesson up to 24 hours in advance with no charge. Instructors have the option to reschedule or approve refunds less than 24 hours prior to lesson. No show lessons are charged the full price of the lesson. If a lesson is cancelled during the lesson due to technical issues the lesson may be rescheduled. If Sessions need to refund money to a school for a SchoolBeats Premium membership due to a refund request, cancellation of the Premium membership or lesson content being removed from our website for any reason, the maximum amount refunded will not exceed the original amount paid by customer. Lessons may come and go from the platform and our maximum liability is limited to any membership fees paid. Regarding private workshops ordered, if a school or individual pays a fee to Sessions for a private workshop any refund made will be limited to the price paid for that workshop. Sessions does not guarantee that all material will be working at all times on its site and we may choose to drop lessons, videos or courses from the site at any time without notice. Any refunds will be limited to the currently paid membership for the most recent monthly term. Our new EEi Certification video course is available at no cost for students and teachers that register for the course; however, this course may be discontinued from the site at any time in the future. We will endeavor to periodically update the course videos as the EEi platform changes. We are not affiliated with Hal Leonard Corporation who owns the EEi platform.

Cancellation of Membership – Either party may terminate this agreement at any time for any reason. Please send us an email or call us at 800-894-7033 to terminate the agreement. If you are dissatisfied with the service we are greatly interested in having detailed feedback so that we may continue to improve. Please feel free to communicate with us and drop us a line with your thoughts and ideas at any time. 2020 is Sessions Academy’s 1st year using our video conferencing system. There will undoubtedly be technical issues as we coordinate instructors, students and virtual streaming technology. However, excellent customer service will remain at the forefront of our mission. During year one, our director, Jim Gross, will be handling any customer service that extends beyond the the instructors reach.

License – Unless otherwise stated, Sessions Academy and/or it’s licensors own the intellectual property rights for all material on Sessions Academy. All intellectual property rights are reserved. You may view and/or print pages from https://sessionsacademy.org for your own personal use subject to restrictions set in these terms and conditions. You must not: republish material, sell, rent or sub-license material, reproduce, duplicate or copy material, redistribute content from Sessions Academy (unless content is specifically made for redistribution). All footage recorded by Sessions Academy in our virtual classrooms or live in our studio will remain the exclusive property of Sessions Academy. This footage includes workshops, presentations, prerecorded lessons and concerts. However, periodically material under copyright will be presented in our classrooms or on our site, in which case copyrights remain with the current owner.

Teachers – We use established professional services to vet potential teachers, instructors, contractors and staff. This may also include drug testing and other checks that we may decide to use to help keep our membership safe. We may also give hiring preference to instructors that have specific professional memberships and/or degrees and experience that may benefit our students and members. We require instructors in classrooms at all times and record online lessons and presentations for the safety of our members. None of our instructors are employees of Sessions Academy. They are contractors and have no employee/employer relationship and are accessing our portal to give music lessons. Our teachers and members agree that group workshop room presentations are recorded and may be available on-demand for members.

Members – The majority of our users/members are students ranging from middle through high school. Additionally, we market directly to schools for their teachers to use our platform in the classroom. We also welcome adult students and all of our instructors are well-trained in giving adult private music lessons. We require all paid members to accept terms and conditions and privacy policies. For members under 13 we require an adult to sign them in and use the adult’s email address/contact info. While we have aggressively pursued the creation of a safe educational music platform, an adult should always be present to monitor children in the classrooms and private lessons. Users acknowledge that due to the live video conferencing features involved in our public and private classrooms that we may not be able to immediately censor content as it is happening so all users/members understand there are inherent risks associated with live video feed content and are using at their own risk. We use a 5 tier safety system:

1. There will always be a teacher present in any live video presentation/lesson.

2. All live group and private lessons are recorded strictly for student safety.

3. All of our classrooms have a “report abuse” button in them sending info. to our director.

4. All classrooms are password protected and are not open to the public.

5. Instructors are able to eject any student from a classroom at any time.

Use of material on other sites and/or devices – The audio and video content on this site has been made available to active members to be viewed exclusively at Sessions Academy Website for the purpose of musical training. Students agree that any lessons that are recorded are for learning purposes and may not be uploaded on any website or social media site or downloaded on their electronic devices.

Hyperlinking to our Content – Certain parts of this website may offer the opportunity for users to post and exchange opinions, information, material and data (‘Comments’) in areas of the website. Sessions Academy does not screen, edit, publish or review comments prior to their appearance on the website and comments do not reflect the views or opinions of Sessions Academy, its agents or affiliates. Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws Sessions Academy shall not be responsible or liable for the comments or for any loss cost, liability, damages or expenses caused and or suffered as-a-result of any use of and/or posting of and/or appearance of the comments or material on this website.

Banning Users – Sessions Academy reserves the right to monitor all comments and content to remove any content and/or users which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms and Conditions. Sessions Academy shall have the right to remove or ban students or cancel membership (with no refund) for conduct on the site which it feels is inappropriate or offensive, and may remove users or members from virtual group and private instruction classrooms at any time.

Copyright Use –

To the extent that students and teachers exchange lesson material that may include copyrighted content such as songs and music, Sessions Academy shall always use Fair Use Standards in presenting the material in an educational setting. This is presented in our group virtual classrooms, prerecorded lessons and private music lessons.

You warrant and represent that you are entitled to post music or comments on our website and have all necessary licenses and consents to do so; the comments/content do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary right of any third party; the comments/content do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material or material which is an invasion of privacy; the comments/content will not be used to solicit or promote business or custom or present commercial activities or unlawful activity. Sessions Academy may delete any comments or music, audio, video, streaming or other posts to the site including messages, texts and other exchange of communication in any of its classrooms any time that it feels may be an infringement on any held licenses or may be offensive. As it is not our intention to infringe on any held licenses, Sessions Academy acknowledges that any works uploaded or exchanged on our site or in our classrooms remain the property of any license holders. Members or users take full legal responsibility for any content they upload to our site or download from our site to their electronic devices. Sessions Academy will not be liability for any damage as a result of streaming, posting, uploading or downloading music, video, content or comments in any of our virtual classrooms.

You hereby grant to Sessions Academy a non-exclusive royalty-free license to use, reproduce, edit and authorize others to use, reproduce and edit any of your music, video, streaming content and comments in any and all forms, formats or media. This applies to members, users and teachers. While we may state that we record lessons and concerts, due to inconsistencies in technology we can’t guarantee that recordings will be available of content.

Link Usage –

Related and approved organizations may link to our home page, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site. We may consider and approve in our sole discretion other link requests.

Use of Third-Party Links
The video conferencing pages and classrooms have helpful audio links that we have researched and found online. Several of them are listed as tools within the classrooms.

Third-party links on Sessions site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy. Sessions does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. In some cases visitors will click an affiliate link for music related products such as sheet music and instruments. We are not responsible or able to interact with any issues relating from purchases or refunds due to our affiliate relationships.

To link to our site you must notify us by sending an e-mail. Please include your name, your organization name, contact information (such as a phone number and/or e-mail address) as well as the URL of your site, a list of any URLs from which you intend to link to our Web site, and a list of the URL(s) on our site to which you would like to link.

Paid members and private students agree that our liability is limited to the cost of the paid membership or lesson fees for the current period or lesson.

PRIVACY POLICY FOR SESSIONS ACADEMY

The privacy of our site visitors, teachers and members is important to us. We created this site for use of members 13 years and older. Users under the age of 13 must have a legal guardian sign-up and be present for all lessons and classrooms. Generally, our virtual group classrooms are off-limits to children under 13 due to the chat features present on the video conferencing platform.

It is Sessions Academy’s policy to respect your privacy regarding any information we may collect while operating our website at “sessionsacademy.org. We respect your privacy and are committed to protecting personally identifiable information you may provide us through the Website. We have adopted this privacy policy to explain what information may be collected on our Website, how we may use it, and how and when it may be disclosed to third parties. This Privacy Policy, together with the Terms and conditions posted on our Website, set forth the general rules and policies governing your use of our Website.

-Website Visitors

Sessions Academy collects non-personally-identifying information that may be made available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Sessions Academy’s purpose in collecting non-personally identifying information is to better understand how Sessions Academy’s visitors use its website.

Sessions Academy also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on https://sessionsacademy.org blog posts. Sessions Academy only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

– Gathering of Personally-Identifying Information

Members and instructors interaction with Sessions Academy require that we gather certain personally-identifying information. The amount and type of information that Sessions Academy gathers depends on the nature of the interaction. For example, we ask visitors who sign up for a membership at https://sessionsacademy.org to provide a name, username, email address, city, state, zip, and instrument. They may choose to provide an Avitar for the Word Press User Profile. Also credit card and password info is created.

Registering an Account – To create an account on our site we require you to provide your name, email address, verify you are over 13, add a credit card, create a user name and provide a password. Uploading of avatars is optional. Users may check buttons for receiving newsletter, automatic renewal and accepting terms and conditions. Some classes, such as or newly added EEi Certification Course require registration even though they may be free to join. This allows students to agree to terms and conditions and read our privacy policy. Students under 13 should have their parents register for any class on our site using their own email address and monitor usage.

Video Conferencing – Each of our 6 group classrooms and all private lessons utilize video conferencing technology using Zoom and a 3rd party for storage and hosting. These classrooms capture and record the following types of personally identifiable information: Audio and video recording, webcam video and audio, chatting in the classrooms, emojis, breakout rooms for group learning, polling, sharing screens and slides, whiteboards. By participating in these group or private lessons you are agreeing to the sharing and recording of this personally identifiable information. (Currently, these workshop rooms are not active on our site).

Other Types of Information – Members may share information about themselves with other members. We retain student lists of students attending each of our group and private virtual classrooms as well as students taking prerecorded classes. We may at times send a marketing email to these lists regarding upcoming lessons. You can unsubscribe from these communications. We may also contact you to help coordinate lessons, billings, refunds and other business as needed.

Transferring Files – Each of our virtual classrooms have white-board features allowing for file transfer and computer sharing (by the moderator/presenter). Files transferred are copied and retained on our servers or that of our third party website provider. These files are not encrypted and they could be hacked or disclosed in legal proceedings.

Community Chat IM and Forums – Sessions Academy has a buddy chat system and forum features that may be made available to members at some future point. You are under no obligation to use these features and do so at your own risk. Currently forums are turned off on Sessions Academy website.

Data Security – While we make every reasonable effort to safeguard the security of our systems, we cannot guarantee the safety of any information you transmit to our company or site. We will attempt to contact you electronically should we become aware of any security systems breach so that you may take protective measures. We use a Stripe billing system which is a popular paid add- on service for our Word Press site. However, we do not keep credit card info. on our servers. Since credit card data is encrypted by our 3rd party service we do not have ability to offer guarantees  re. the safety of clients personal data and billing information.

– Children Under 13

Sessions Academy follows the Children’s Online Privacy Protection Act (COPPA) and is committed to protecting the privacy of young children. We do not knowingly collect or maintain personally identifiable information from persons under 13 years of age without the consent and permission of a parent or legal guardian. If you are under 13 please do not use the Sessions Academy site or service. New members will be asked their age at log in and advised that if they are under 13 not to continue without a guardian. We will take prompt and appropriate action to delete any information collected that personally identifies children under the age of 13. However, our billing provider may be required to retain charged/refunded billing information for legal purposes. Guardians of a child under 13 who believe their child has created a Sessions Academy Membership in violation of our policy should contact us at the contact info below or our site contact form.

– Advertisements

At this point we do not allow any external ads on our site except for our affiliate agreements with Sheet Music Plus, Sam Ash and Amazon for specific music products, however cookies may still allow ad servers to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by Sessions Academy and does not cover the use of cookies by any advertisers.

– Links to External Sites

Our website may contain links to external sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy and terms and conditions of every site you visit as we have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites, products or services.

– Protection of Certain Personally-Identifying Information

Sessions Academy discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that need to know that information to process orders. Some organizations may be located outside of the US; by using Sessions Academy’s website, you consent to the transfer of such information to them. Sessions Academy will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Sessions Academy discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Sessions Academy believes in good faith that disclosure is reasonably necessary to protect the property or rights of Sessions Academy, third parties or the public at large.

Communication – emails – Sessions Academy may occasionally send registered users an email to tell you about new features, or keep you up to date with what’s going on with Sessions Academy. At sign-in you will have a box to check/uncheck regarding receiving newsletters. We primarily use our blog to communicate information, so we expect to keep this type of email to a minimum. If you send us a request we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Sessions Academy strives to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information. The system will automatically send out a range of emails in response to registration, password reset, membership access, lesson confirmation, and newsletter acceptance requests.

– Cookies

Sessions Academy uses cookies to help identify and track visitors, their usage of https://sessionsacademy.org, and their website access preferences. Sessions Academy visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Sessions Academy’s websites, with the drawback that certain features of Sessions Academy’s websites may not function properly without the aid of cookies. By continuing to navigate our website without changing your cookie settings, you hereby acknowledge and agree to Sessions Academy’s use of cookies.

– E-commerce

In purchasing services or products you are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. Sessions Academy collects information only as is necessary to fulfill the purpose of the visitor’s interaction with Sessions Academy. We do not disclose personally-identifying information other than as described here. And visitors can always refuse to supply personally-identifying information, however it may prevent them from engaging in certain website-related activities.

– Business Transfers

If Sessions Academy, or substantially all of its assets, were acquired, or in the unlikely event that Sessions Academy goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Sessions Academy may continue to use your personal information as set forth in this policy.

Privacy Policy Changes

Sessions Academy may update its Privacy Policy from time to time, in its sole discretion. Please check this page for any changes to its Privacy Policy frequently. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
